Terms of service
Version of 1 November 2026
These terms govern the use of DustRide: the Android and iOS apps and the website app.dustride.pl. They are the rules for services provided electronically within the meaning of the Polish Act of 18 July 2002 on providing services by electronic means, and the terms and conditions within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act, "DSA"). Read them before creating an account: creating one requires accepting them, and so does using DustRide after a new version comes into force. You can save or print this page at any time. Earlier versions of these terms are available on request.
1. Who provides DustRide
DustRide is provided by Adventure Zbigniew Tarnawski (NIP 7681534840, ul. Berberysów 21, 40-750 Katowice) ("we", "us"), a business entered in the Polish Central Register and Information on Economic Activity (CEIDG). You can reach us at admin@dustride.pl. That address is also our single point of contact for users and for authorities under Articles 11 and 12 of the DSA. We answer in Polish and English.
2. Definitions
- User: anyone who uses the app or the website.
- Consumer: a user who is a natural person using DustRide for purposes not directly connected with their business or profession.
- Account: a DustRide account, created in the app with an email address and a password or, for an organizer, on the administrator's invitation.
- Ride: a shared ride in the app, identified by a code, with the route the riders follow and their live positions on a shared map.
- Participant, organizer, administrator: the roles an account can have. Every account is a participant and can join rides. An organizer can also create rides. The administrator manages roles and accounts.
- Content: ride names, routes, the name the group sees, and the alerts and messages sent in a ride.
3. What DustRide provides
-
Free of charge, we provide:
- an account, with your ride history and settings kept on our servers;
- for organizers: creating rides with a route loaded from a GPX file or shared from Google Maps, and planning rides on this website;
- joining a ride with its code or its QR code;
- sharing your live position with the other riders in the same ride, including while the app runs in the background, and seeing theirs;
- for organizers, in rides they take part in, and for the administrator: watching a ride live on this website;
- sending alerts and short messages to the other riders in a ride, reporting messages and blocking whoever sent them;
- a map that can be downloaded for use without signal along a ride's route.
- What the service is, and its limits. DustRide passes positions, alerts and messages only to the riders in a ride who have the app running and an internet connection at that moment. Delivery depends on network coverage, battery, phone settings and the recipient's device. Positions, alerts and messages are not stored on our servers and are not sent again.
- We do not receive, read or monitor alerts or messages, and we do not pass them to emergency services or to anyone other than the riders in the ride. DustRide is not an emergency alerting system, a safety device or turn-by-turn navigation. It does not replace the 112 emergency number, your own judgement of the road and the terrain, or what your group agrees to do in case of a breakdown or an accident.
- The map is built from OpenStreetMap data made by its community, and the route is loaded by the organizer. When an organizer shares a route from Google Maps, the way between its points is worked out by a Google service. The map and the route may contain errors or be out of date; they do not tell you whether you are allowed to ride a given stretch.
- Choosing who an alert or a message is for ("organizer only" or "everyone") decides who receives it. Alerts and messages marked "organizer only" reach only the ride's organizers, in the app and on the website, and the administrator; if no organizer is in the ride, or an organizer sends one, it goes to everyone. If an organizer's phone has an older version of the app, such alerts and messages may reach every rider's phone, but only the organizers' phones show them.
4. Technical requirements
- A phone with Android 8.0 or later, or an iPhone with iOS 16 or later, with GPS. The website needs an up-to-date browser with JavaScript and cookies enabled.
- An internet connection to create and join rides, to share positions, alerts and messages, and to sign in. A downloaded map, the route and your own position work without one. Your mobile operator's charges for the connection are yours.
- Permission for the app to use your location. To read a ride's QR code: permission to use the camera. On Android: permission to show notifications, so that you can see when your position is being shared.
- An email address at which you can receive mail.
5. Risks of using the service, and data stored on your device
- Like any service provided over the internet, DustRide comes with risks we must tell you about: someone taking over your account, for example with a guessed password or one you use elsewhere; messages pretending to come from us to get your password (phishing); malicious software on your phone; and your position being visible to people you do not know, if you join a ride with such people.
- To reduce them: use a password you use nowhere else, keep your phone's system and the app up to date, never give your password to anyone (we never ask for it), join only rides from people you trust, do not pass a ride's code on without the organizer's agreement, and leave the ride when you have finished riding.
- The app stores on your phone what it needs to work: your sign-in session, settings, recent rides, the loaded route, the trail of your ride, alerts from recent rides, the list of riders you have blocked, and the map downloaded for use without signal.
- The website stores a session cookie in your browser and, once you are signed in, a cookie that keeps you signed in. The live ride page also stores a random identifier in the browser's storage. None of them is used for tracking. The privacy policy gives the details.
6. Your account and the agreement
- Making the agreement. To make the agreement, you enter an email address and a password in the app (and, if you wish, the name the group will see you by), tick the box by which you accept these terms and declare that you are 18 or older, and then enter the six-digit code we send to that address. Until you enter the code, you can correct what you entered by going back to the previous screen. The agreement to use DustRide is made when your email address is confirmed, and lasts until the account is deleted. It can be made in Polish or in English. We record which version of the terms was accepted, and when.
- An account created on the administrator's invitation becomes active once its password is set; at the first sign-in we ask for these terms to be accepted.
- Age. Only adults with full legal capacity may create an account. By creating one, you declare that you are 18 or older. If we learn that an account was created by a minor, we will delete it.
- Your obligations. Give a real email address, share your password with no one, and use only your own account. Write to admin@dustride.pl if you think someone else is using it.
- The organizer role. The administrator decides who is given the organizer role. A participant who wants to create rides may ask for it, but is not entitled to it.
- Ending the agreement yourself. You can end the agreement at any time, free of charge and without giving a reason, by deleting your account in the app (menu, "Your account", "Delete my account") or as described at app.dustride.pl/delete-account.
- Withdrawal. A consumer may withdraw from the agreement within 14 days of making it, without giving a reason and at no cost. Before the deadline, delete the account in the app, send a statement to admin@dustride.pl, or use the form in Annex 1 (using it is not required). We confirm by email without delay that we have received the statement. After a withdrawal we delete the account as described in the privacy policy. DustRide is free, so neither side owes the other anything.
- Notice from us. We may terminate the agreement on 14 days' notice, by email and stating the reason, only if: you break section 7 and do not stop despite being asked to; you do not accept a new version of these terms within the time set in section 15; or you gave false information about your age.
- Termination without notice. We may terminate the agreement without notice only if: you provide illegal content; you gained or tried to gain access to someone else's account or data; you disrupt the service as described in section 7; or you use DustRide to commit an offence.
- Before terminating, we may suspend the account while we look into the matter, for no longer than 30 days. In every case we give the reason and say how to appeal (section 12).
- Ending the DustRide service as a whole follows the notice period in section 15(6).
- When an organizer's account is deleted, the rides it created stop being available to every rider in them.
7. Rules of use
You must not:
- provide illegal content, including content that infringes other people's rights, contains threats, harassment or insults, or discloses someone else's personal data without a legal basis;
- send obscene, sexual, hateful, violent or otherwise objectionable content, or harass or insult other riders;
- use a name that impersonates someone else or is offensive;
- pass a ride's code to people you know the organizer does not want in the ride;
- record other riders' positions or use them for anything other than taking part in the ride;
- disrupt DustRide: attempt to access other people's accounts or data, probe or overload our servers, or use the app or its data by automated means;
- use DustRide for any unlawful purpose.
We do not tolerate objectionable content or abusive users. Any rider can report a message, or block whoever sent it (sections 11 and 12). We remove content that breaks these rules, and we may suspend or delete the account that sent it.
8. Organizers
- We do not organize rides and are not a party to arrangements between an organizer and the riders. The organizer decides who rides with them by choosing whom to give the ride's code, and is responsible for the ride, including that the route may lawfully be ridden: that they have the consent of the landowner or manager where it is needed, in particular on forest roads and private land.
- The organizer makes sure the riders know what DustRide shows the group about them, including that the organizer can also follow the ride from a browser.
- An organizer may upload a route only if they have the right to share it. The route file is passed to the riders unchanged, together with the data it contains (for example waypoint names, its author or timestamps).
- An organizer may also use DustRide in their business, for example in a riding school or on guided tours. They are then responsible to their customers for their own obligations as a business, tell them who they are, and do not present DustRide as a safety or emergency system.
- An organizer who uses DustRide in the course of a business or profession is a separate controller of the riders' data they see in DustRide. They are responsible for informing the riders about that processing and for its legal basis, may not record or use the riders' positions for anything other than running the ride, and may not make taking part in a ride conditional on sharing a position if the rider objects.
9. Safety
- Do not look at or operate your phone while riding. Stop safely first. Mount the phone securely, and comply with the traffic law, including the rules on using a phone while driving.
- Riding a motorcycle, especially off road, carries a risk of accidents, injury and damage to the vehicle. You take part in a ride at your own risk: you judge for yourself whether your skills, health, protective gear and the condition of your vehicle are up to the route, and you may drop out at any time.
- Ride only a vehicle that is roadworthy and insured where the law requires it, and only if you hold the licence required to ride it.
- Ride only where the law allows motor vehicles. In Poland, motor vehicles may use forests only on public roads and on forest roads signposted as open to such traffic. Obey signs, barriers, closures and the instructions of land managers, even where the ride's route goes another way. Do not enter private land without the owner's consent; if you end up on it by mistake, leave by the shortest way.
- Respect nature and other people: stay on the track, do not damage crops or surfaces, keep the noise down near buildings, and give way to walkers, cyclists and horse riders.
- Positions, the route and the map may be inaccurate, out of date or missing, and other riders may not see you. Alerts and messages come from other riders and may be wrong. Always judge the terrain and the road yourself.
- In an emergency, call 112. An alert in DustRide is not a call for help and may never reach anybody.
10. The app, and content you share
- The apps, the website and the DustRide name belong to us or to those who licensed them to us. While the agreement lasts, we give you a free, non-exclusive, non-transferable licence to use the app on your own devices for what it is made for, including when organizing rides in the course of a business. You may not copy, modify or decompile it, except where the law allows you to.
- Content stays yours, and you are responsible for it. You give us a non-exclusive, royalty-free licence, without territorial limits, to record and reproduce it digitally, store it on servers and make it available to the riders in the ride it is meant for, solely to provide the service and for as long as we keep it under the privacy policy.
- The map is built from OpenStreetMap data (© OpenStreetMap contributors, under the Open Database License) and is provided by MapTiler. The app includes open-source software, used under its licences, which the app lists under "Your account", "Open-source licences".
11. Reporting illegal content, or content that breaks these terms
-
If you think something in DustRide is illegal (a name, a ride name, a route or a
message), write to admin@dustride.pl, giving:
- why you consider the content illegal;
- where it is: the ride code and, for a message, the rider's name and roughly when it was sent;
- your name and email address, unless the report concerns child sexual abuse material, when they are not required;
- a statement that you believe in good faith that the report is accurate and complete.
- In the app, the menu (⋮) on a message lets you report it and prepares such an email for you. Content that breaks these terms without being illegal can be reported the same way.
- We will confirm that we have received the report, review it promptly, decide on it carefully and without automated tools, and then tell you our decision and how it can be challenged.
- If, through a report or otherwise, we obtain information giving rise to a suspicion that a criminal offence involving a threat to someone's life or safety has taken place, is taking place or is likely to take place, we will inform the police or the public prosecutor. This does not cover alerts sent in rides: we do not receive them and cannot act on them.
12. Moderation, and challenging it
- We do not check content before it reaches the riders. The app automatically masks the worst swear words and slurs in messages, using a fixed list of words, on the phone that sends a message and on the phones that receive it. Beyond that, content in DustRide is reviewed by a person when it is reported to us or when we come across it; no automated tool takes any other decision about content, or any decision about accounts.
- If content is illegal or breaks these terms, we may remove it, hide the ride, take away a role, or suspend or delete the account. We act in proportion to the breach.
- We tell the person our decision concerns, by email: what we did, to what extent and for how long, why, whether the decision follows a report, on what basis (a provision of law or of these terms) and how it can be challenged, unless the law forbids it.
- In the app you can also block a rider: that person's messages stop showing on your phone, in every ride. Nobody is told, the block is stored only on your phone, and you can undo it under "Your account". A block does not hide that person's position or alerts.
- You can challenge our decision, or our refusal to act on your report, by writing to admin@dustride.pl within 6 months. Where possible, someone who did not take the decision reviews it, and we answer within 14 days. You can also go to court, or lodge a complaint with a Digital Services Coordinator.
13. Complaints
- You can complain about how DustRide works, or about the service not conforming to the agreement, by email to admin@dustride.pl. Give the account's email address, a description of the problem, your phone model and system version and, if it concerns a ride, its code.
- We answer by email within 14 days of receiving the complaint. If we do not answer a consumer's complaint in that time, it is deemed accepted.
- If the service does not conform to the agreement, a consumer may demand that it be brought into conformity and, if that proves impossible or does not happen within a reasonable time, may withdraw from the agreement.
- A consumer may use out-of-court ways of resolving complaints and claims: free help from a municipal or district consumer ombudsman, mediation or a permanent consumer arbitration court at a regional Trade Inspection office, and, for someone living in another EU country, the European Consumer Centre. The President of UOKiK keeps the list of bodies entitled to do this (uokik.gov.pl). We have not committed in advance to taking part in such proceedings; we say whether we agree when we answer a complaint we did not accept.
14. Liability
- Towards consumers and the persons referred to in section 16, we are liable for not performing the agreement or performing it improperly, and for torts, as the law provides. These terms do not exclude or limit that liability.
- A position, alert or message that is not delivered, or a map that is not available, for the reasons described in sections 3 and 4 that are outside our control, in particular no signal or a phone that is switched off or so set up, is not improper performance of the agreement.
- To use DustRide you need services that you choose yourself and that we do not provide: a mobile network, a phone with its operating system, and an app store. Their providers are responsible for them.
- Towards other users (businesses for which the agreement is professional in nature) we are liable only for damage caused intentionally or through gross negligence, up to PLN 1,000 in total, and not for lost profits. This limit does not apply to personal injury or to liability that the law does not allow to be excluded or limited.
15. Changes to these terms, to the service, and the end of the service
- We may change these terms only for a valid reason, namely: a change in the law, or a court ruling or authority decision affecting their content; adding, changing or withdrawing a DustRide feature, or changing a provider we use, to the extent that the description of the service or the rules for using it must change; the need to prevent abuse or to keep the service and its users safe; or correcting an obvious error or ambiguity without changing either side's rights and obligations.
- A change may cover only the provisions the reason concerns. We do not introduce charges or new purposes for processing data this way.
- We tell you about a new version by email at least 14 days before it comes into force, saying what changes. A change required solely by law may come into force sooner if the law requires it.
- A new version binds you from when you accept it in the app or on the website. Until then the previous version applies to you, and after the new version comes into force, features that need you to be signed in are paused until you accept it. If you do not accept the change, you can delete your account at any time, free of charge. If within 30 days of the new version coming into force you have neither accepted it nor deleted your account, we may terminate the agreement under section 6(8).
- We supply the app in its current version and publish its updates, including security updates, in the app stores. An out-of-date version may stop working; the app will tell you. We may change DustRide's features for the reasons in point 1 (other than correcting errors), at no cost to you. We will tell you by email, reasonably in advance, about a change that significantly and negatively affects your use of the service, saying what it is and when; you may then end the agreement without notice by deleting your account.
- We may stop providing DustRide by telling account holders by email at least 30 days in advance. Until that day, organizers can download their routes.
- We may transfer the provision of the service to another entity, in particular to a company through which we will continue to run DustRide. We will tell you by email at least 30 days in advance. The transfer requires your consent, given in the app or on the website; if you do not give it, the agreement ends on the day of the transfer.
16. Sole traders treated as consumers
The provisions of these terms that concern consumers, as regards unfair contract terms, withdrawal and the conformity of the service with the agreement, also apply to a natural person making an agreement directly connected with their business where the content of the agreement shows that it is not professional in nature for them, as shown in particular by the business activity entered in the CEIDG (Article 385⁵ of the Polish Civil Code and Article 7aa of the Consumer Rights Act). Such a person may state, at the latest when making the agreement, whether it is professional in nature for them; this is not a condition of making the agreement.
17. Personal data
How DustRide processes personal data is described in the privacy policy. It is not part of the agreement, and changing it does not require your acceptance.
18. Final provisions
- The agreement is governed by Polish law. This choice does not deprive a consumer of the protection given by the mandatory law of the country where they habitually live.
- Disputes with consumers and with the persons referred to in section 16 are settled by the courts that have jurisdiction under the law; a consumer may also bring a claim before the court of the place where they live. Disputes with other users are settled by the court competent for our registered address.
- These terms are available in Polish and English. For a consumer who is a Polish citizen, the Polish version is the basis for interpretation. Other users are bound by the version they accepted. If the versions differ, a consumer may rely on the one more favourable to them.
- We do not apply any codes of conduct.
- If you downloaded the app from Apple's App Store, Apple's standard licence agreement (Licensed Application End User License Agreement) also applies to the app itself. The agreement to use DustRide is between you and us, not Apple. If they conflict, these terms prevail, and the provisions of Apple's agreement that limit liability or warranties do not limit a consumer's rights under these terms or under the law.
